| 内容記述 | 集団所有の農地における農家の経営請負制度が中国の農村改革を特徴づける重要な施策として、農村土地請負法や物権法などの法的整備とともに長期化・固定化する方向に展開されている。そのような手法を踏襲し、集団所有の林地にも適応させようとする試行錯誤が繰り返されてきた。しかし、林業の発展や林地に対する農家の投資と経営意欲のインセンティブに直結されえなかったことも指摘されている。農業・農村の近代化と生態環境の整備の両立および都市・農村間格差の縮小をめざす「新農村建設」の関連施策の一つとして、「集団林権制度改革」も2008年以降急速に進められている。太行山脈の一部を取り囲む河北省の現地では「均山」制を中心とする方式が実践されている。本稿は、農村土地の集団所有と経営請負制の歴史的変遷とそれをめぐる法的土台づくりをふまえながら、現時点での集団林地制度改革に関する政策の分析を試みる。さらに農村社会の構造的特徴を通して、林地をふくめた農地の集団所有の性格とその方向性を検討する。 | |||||

| 内容記述 | In China, the agricultural contracting system governing the collective ownership of land is an important policy, and a special feature of rural reform. The agricultural contracting system law and real right laws will remain a permanent feature of the reform policy for the foreseeable future. In the past, there have been several attempts to apply the principle of collective ownership to mountain and forest areas, but it has been found that it was not possible to incentivize the commercial development of mountain and forest areas. Since 2008, the implementation of the new collective mountain land policy reforms has made rapid progress. These reforms are part of the policy of "rural reconstruction" to modernize agriculture and rural infrastructure, and to develop and maintain the ecological infrastructure, while at the same time reducing the gap between rural society and the towns. On the border of Hebei Province by the Taihang Mountain Range, a system of mountain land partition has been tried out. The aim of this paper is to attempt an analysis of the present reforms around the collective ownership of mountain farmland based on the historical changes in collective ownership, the system of agricultural contracting, and the creation of a legal framework. Reference will be made to the special structural features of rural society in order to investigate the nature and future direction of the collective ownership of land, which now includes mountain farmland. | |||||
